GENERAL CONDITIONS OF USE

These General Terms of Use ("GTU") determine the rules for accessing the website accessible at the URL https://www.the-french-concierge.com/ (hereinafter "the Site") which is published by The French Concierge, a simplified joint stock company, share capital of €1,000.00, registered in the Paris trade and companies register under number 899 525 117, having its registered office at OFFICE 562 59 RUE DE PONTHIEU 75008 PARIS (hereinafter, "The French Concierge", "We", "Our", "Our") and for using the services and functionalities resulting therefrom, as well as their conditions of use by any person ("User", "You", "Your", "Yours").

The Services offered on the Site are provided “as is” and are governed by these General Conditions of Use.

I. Acceptance and application of the T&Cs

The provisions of these T&Cs apply to any use of the Services by the User, in particular if You visit the Services, regardless of Your capacity (individual or professional), the location where You are located, the methods of connection to the Services, the purpose and the purpose of Your access to the Services. Consequently, You agree to consult the T&Cs before any use of the Services. By using all or part of the Services, You are considered to have read and accepted these T&Cs. You agree to comply with the provisions of these T&Cs each time You use the Services.

II. Access to Services

The User is informed of the risks inherent to the Internet, particularly in terms of: - lack of security in data transmission; - non-guaranteed continuity in access to the Services. Under no circumstances can We be held responsible for these risks and their consequences, which are detrimental, whatever their extent, for the User. It is up to each User to take all appropriate measures to protect their own data, software and hardware from contamination by viruses or other forms of attacks that may circulate through the Services or the information published. The User is and remains responsible for the terms and consequences of access to the Services. This access may involve the payment of connection fees to technical service providers such as Internet access providers or electronic communications or telephone operators. These fees remain the responsibility of the User. In addition, the User is and remains entirely responsible for the provision and use of the equipment necessary to access the Services. The User may not rely on any difficulty in accessing the Services to access information in violation of these T&Cs.

III. Rights and obligations of the User

The User of the Services acknowledges having the skills and the hardware and software resources necessary to access and use the Services. The User undertakes to comply with the provisions of the T&Cs as well as all applicable laws and regulations when using the Services. It is recalled that the acts of fraudulently accessing or remaining in a computer system, hindering or distorting the operation of such a system, fraudulently introducing or modifying data in a computer system constitute offenses punishable by criminal sanctions. In particular, the User undertakes to:

  • Not to compromise, damage, disable, overload, disrupt or interfere with the security or operation of the Services or the information and operating systems of The French Concierge or its potential service providers;
  • Not to hinder the normal operation or make fraudulent use of the Services, in any manner or form whatsoever;
  • Not to use or permit the use of the Services in an abusive or unlawful manner, for any unlawful, fraudulent or malicious purpose; including, without limitation, by hacking into the Services or introducing malicious code, including viruses, or harmful data into the Services, using any system, device or program to extract data or information from the Services or The French Concierge’s servers, sending or storing materials containing viruses, worms, Trojan horses or other harmful computer code, files, scripts, agents or programs, interfering with or impairing the integrity or performance of the Services and the data contained therein or attempting to gain unauthorized access to the Services, its associated systems or networks.

IV. User Responsibility

The User of the Services is liable for damages of any nature, material or immaterial, direct or indirect, caused to any third party, including The French Concierge, due to the illicit use or exploitation of the Services itself and/or any of their elements, whatever the cause and place of occurrence of such damages, and guarantees The French Concierge against the consequences of any claims or actions to which it may, as a result, be subject. The French Concierge cannot be held liable for any damage or prejudice of any nature whatsoever, directly or indirectly originating from a breach by the User of these T&Cs. In the event of a violation by the User of any of the provisions of the T&Cs, The French Concierge reserves the right to suspend, temporarily or permanently, without prior warning, access to and use of the Services. In the event of non-compliance with the applicable regulations and these T&Cs, the User's civil and/or criminal liability may be incurred.

V. Liability of The French Concierge

The purpose of the Site is to:

Present the destinations and houses offered for seasonal rental by The French Concierge.

Allow interested users to request to be contacted in order to obtain more information on a property and/or to reserve it.

Allows owners wishing to offer a property for rental on the Site to contact us.

The French Concierge has taken the greatest precautions regarding the operation and maintenance of the Services. However, The French Concierge does not guarantee in any way that access to the Services will be uninterrupted, easy, reliable, correct, complete, satisfactory or fast. The French Concierge strives to disseminate precise, accurate and up-to-date information on the Services. The French Concierge reserves the right to modify or update the content and features of the Services at any time and without notice. The French Concierge cannot guarantee total reliability, accuracy, completeness, truthfulness or updating of the content of the Services. The User is invited to report any information that appears to be inaccurate and, where appropriate, to suggest any improvement that appears useful. The French Concierge strives, as far as possible, to ensure that the User has access to the Services at all times and a reasonable level of operation and availability of the Services. However, The French Concierge does not guarantee the durability, availability and stability of the Services. Access to the Services may be interrupted for any reason, whether or not it is within the control of The French Concierge, in particular due to the vagaries of the Internet, in the event of force majeure, maintenance, updates or technical improvements, or to develop the content and/or presentation. Access to the Services is provided as is. The French Concierge shall not be held liable for damages that do not originate from a breach by The French Concierge of these T&Cs or from a proven fault by The French Concierge. In any event, The French Concierge shall not be held liable for indirect damages that result from:

  • From the use of the Services, and in particular any operating loss, financial or commercial loss, loss of programs and/or data in particular in the User's information system, or threats such as in particular viruses, bugs, malicious codes, Trojan horses, logic bombs, worms and other anomalies which may occur on the Internet network;
  • Contents of the Services and/or use of websites linked to the Services or to which Users may have access via the Services;
  • The inability to access the Services, the non-functioning or poor conditions of use of all or part of the Services, for whatever reason;
  • Any omissions and/or errors that may be contained in the Services, and any other element of the Services.

The T&Cs set out the entirety of the obligations and responsibilities of The French Concierge, which cannot be bound by any other express or implied guarantee with regard to the User.

VI. Hypertext links

Hypertext links to the Services:

The User of the Services may not set up hypertext links to the Services without the express prior authorization of The French Concierge, and subject to pointing to the home page of the Services without duplicating the home page or any other page or element of the Services. Also, for any request to create hypertext links to the Services, We thank You for sending an email to: thefrenchconcierge@gmail.com You are prohibited from:

  • Insert the link to the Services from a service of which You are not the publisher;
  • Remove, modify or alter, in any way, the size or appearance of the logos or other distinctive signs of The French Concierge;
  • Mislead any other User and/or any third party or create confusion as to Your relationship with The French Concierge;
  • Present false, misleading, derogatory or deceptive information about The French Concierge;
  • Use the trademarks, logos or other distinctive signs of The French Concierge without the prior, express and written consent of The French Concierge.

The French Concierge expressly reserves the right to revoke the authorization granted under the terms hereof and to take any appropriate action in the event of a breach of the provisions of this Article. You may be held liable for any damages related to or resulting from such a breach. Hypertext links available on the Services: The French Concierge may include on the Services links to websites belonging to third parties or third-party services not published by The French Concierge. You must consult the legal notices and conditions of use of these sites. The French Concierge exercises no control over these external sites and services, does not contribute in any way to the development of the content and/or any element appearing in all or part of these third-party sites or services, does not carry out any evaluation or verification of the relevance, accuracy, completeness or updating of this information. Consequently, The French Concierge cannot be held responsible for their content. You acknowledge that The French Concierge cannot endorse, guarantee or take responsibility for all or part of the content and/or any element appearing in all or part of these third-party sites or services. If You activate these hyperlinks to third-party sites or services, You leave the Services and agree to use the services of these third parties at Your own risk or, where applicable, in accordance with the conditions that govern them. It is the User's responsibility to take the necessary precautions to ensure that the sites visited are free of computer viruses. The French Concierge cannot be held liable, in particular, for the presence of computer viruses on third-party sites or services.

VII. Modifications to the T&Cs

The French Concierge may at any time modify the content of the Services or the terms of these T&Cs and/or temporarily or permanently cease operating all or part of the Services at any time and without notice. The User is therefore recommended to consult the latest version of the T&Cs each time they visit the Services in order to be aware of these new conditions. In any event, browsing the Services or any other use of the Services implies the User's unconditional acceptance of the latest version of the T&Cs. The French Concierge will inform the User, by any means and in particular by email or by posting on the Services, of any significant change to the T&Cs that may have an impact on the terms of provision of Services subscribed to by the User and which have not yet been fully provided, or of any significant change to the Data Protection and Cookies Charter.

VIII. Applicable law and jurisdiction

The law applicable to the T&Cs and the Services is French law, notwithstanding the plurality of defendants and subject to international public policy rules relating to consumer protection.

In the event of a dispute with The French Concierge relating in particular to the provisions of the T&Cs, including the Data Protection and Cookies Policy, the User may contact The French Concierge by post to The French Concierge - BUREAU 562 59 RUE DE PONTHIEU 75008 PARIS, FRANCE or by email to thefrenchconcierge@gmail.com . In this case, The French Concierge and the User will endeavour to find an amicable solution beforehand.

Any dispute arising from the T&Cs which could not result in an amicable agreement under the above conditions will be submitted to the competent jurisdiction.

Miscellaneous

Convention on Evidence

The document reproducing the T&Cs is stored on a durable medium in the form of an image under security conditions that are usually recognized as reliable. The User may at any time make an electronic backup or a paper printout of the T&Cs. As such, the T&Cs are considered proof of communications and an agreement between the User and The French Concierge. The User acknowledges that the evidentiary value of this document cannot be called into question simply because of its form, particularly electronic form.

Non-waiver

The fact that The French Concierge does not require at any time the complete execution of part or all of the provisions of the T&Cs will in no way affect the right of The French Concierge to rely on them subsequently.

Partial invalidity

If any part of the T&Cs should be declared illegal, invalid or unenforceable for any reason, the term or terms in question will be declared non-existent and the remaining terms will retain their full force and scope and will continue to be applicable. The terms declared non-existent will be deemed to be replaced by terms that come closest to the content of the cancelled clause and to the original intention of The French Concierge.
